Wobu Terms of Use and End User Licence Agreement

These terms govern your use of Wobu, a desktop application by Jake Cattrall ("we", "us"). By installing or using Wobu you agree to them. If you do not agree, do not install or use it.

Wobu is free and open-source software. Nothing in this document is intended to add a restriction to the MIT licence the software is released under; where the two ever appear to conflict, the MIT licence wins, and the rest of this document is the plain-English explanation of what that means for a binary you downloaded rather than built.

1. The licence

Wobu is licensed under the MIT licence. The full text is in the LICENSE file, shipped beside the application in every installer and shown in Settings › Licences. In short, you may use, copy, modify, merge, publish, distribute, sublicense and sell copies of the software, for any purpose, commercial or otherwise, provided the copyright notice and permission notice are included with any substantial portion you pass on.

You are not granted any trademark right. You may say your product is built from Wobu; you may not present a modified build as being the official Wobu, or use the name or marks in a way that implies we endorse or support it.

2. Third-party components

Wobu is built from open-source components that keep their own licences. The complete set for the build you are running is in THIRD-PARTY-NOTICES.md, generated from the two lockfiles, shipped beside the application and shown in Settings › Licences. Those licences govern their components, and some may impose conditions on redistribution that you must observe.

3. No service, no account

Wobu is software, not a service. We operate no servers, hold no account for you, and receive no data from the application — see the Privacy Policy. There is nothing for us to suspend, terminate or fail to deliver. We are under no obligation to provide support, maintenance, updates, bug fixes, or continued development, and no feature is guaranteed to keep working or to keep existing in a future version.

4. Bring your own key: your relationship with providers

Wobu generates nothing itself. Text, images and 3D meshes are produced by third-party providers that you configure with your own credentials, and the application talks to them directly from your machine.

Accordingly:

You contract with the provider, not with us. Your use of Anthropic, Google, Tencent Cloud or any self-hosted or remote ComfyUI endpoint is governed by your agreement with that provider and their acceptable-use and privacy policies. You are responsible for reading them and for complying with them, including any restriction on the content you may submit or generate.
Provider terms pass through to you. Where a provider imposes a condition on the content you submit or on the output you receive, that condition applies to your use of Wobu unchanged. We cannot and do not waive, alter or take responsibility for it.
You pay the provider. Every request Wobu sends is billed to your account at the provider's rates. You are solely responsible for those charges, including charges from retries, from a workflow you left running, or from a misconfiguration. Wobu shows estimates where it can; they are estimates only, and never a cap, a quote or a guarantee.
You keep your credentials secure. You are responsible for the keys you enter, for the machine they are stored on, and for any use made of them.
You choose your endpoint. Pointing ComfyUI, or any provider base URL, at a server you do not control authorises Wobu to send that server your prompts and reference-image bytes. That decision, and its consequences, are yours.

5. Your content and generated output

Your projects are yours. We claim no ownership of, and no licence to, the worlds, notes, images, meshes or any other content you create, import or generate with Wobu. Your project folder is on your disk and never passes through us.

Ownership of generated output is determined by your provider agreement and by applicable law, not by us. Different providers take different positions on the rights you have in model output, on whether output may be used commercially, and on whether your inputs may be used to train models. The legal status of AI-generated material also varies by jurisdiction and is unsettled in several. We make no representation about what rights you obtain in anything a provider produces for you, and you should check your provider's terms before relying on output commercially.

You are responsible for what you make. You must not use Wobu to create, import, process or distribute content that is unlawful, that infringes another person's intellectual property, privacy or publicity rights, or that violates your provider's acceptable-use policy. You must not use it to generate material depicting the sexual abuse or exploitation of children, or to impersonate a real person in a deceptive manner. You are responsible for the lawfulness of any reference image you supply, including whether you hold the rights to submit it to a third-party provider.

If you use peer-to-peer sync, you decide who receives a share ticket, and a ticket is enough to receive the project it names. Treat one as you would a link to a private file. You are responsible for what you share and for whom you share it with, and for ensuring you have the right to distribute any content in a project you send. Sync depends on relay and address-discovery infrastructure operated by a third party, described in the Privacy Policy; its availability is outside our control and is not guaranteed.

7. Beta software

Wobu is beta software. Current release bundles are unsigned, and your operating system will warn you about them; download them only from the project's GitHub Releases page and follow the platform-specific guidance in the release documentation. Wobu writes to files you care about. Keep backups. Formats, defaults and features may change between versions in ways that require you to migrate.

8. No warranty

As stated in the MIT licence, and repeated here in plain language: Wobu is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the software will be uninterrupted, error-free or secure, that it will meet your requirements, that any provider will remain available or continue to behave as it does today, or that generated output will be accurate, appropriate, original or fit for any use.

9. Limitation of liability

As stated in the MIT licence: in no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.

This expressly includes lost or corrupted project data, provider charges however incurred, loss of profits or goodwill, and any consequential or indirect loss.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities; in those jurisdictions our liability is limited to the smallest extent permitted by law. Because Wobu is supplied free of charge, no fee has been paid to us in respect of it.

10. Export and sanctions

You are responsible for complying with any export control, sanctions or import law that applies to you when downloading or using Wobu, and with any equivalent restriction imposed by a provider you configure.

11. Changes to these terms

The terms that apply to you are the ones shipped with the version you are running; they are included in the installer and shown in Settings › Legal. New versions may ship revised terms, and continuing to use a new version means accepting the terms it shipped with. Every revision is public in the repository's history. We do not have your contact details, so we cannot notify you individually.

12. Severability and governing law

If any provision of these terms is held unenforceable, the remainder stays in force.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory rules of the law of the country in which you live, or of the right to bring proceedings there.
